Terms of Service (American Gold Tour LLC)

Effective date: January 21, 2026

These Terms of Service (“Terms”) govern your access to and use of the website [americangoldtour.com] (the “Site”) and the services offered through the Site (collectively, the “Services”). By using the Site or Services, you agree to these Terms.

If you do not agree, do not use the Site or Services.

1) Who we are

The Services are offered by American Gold Tour LLC (“AGT,” “we,” “us,” “our”). AGT is a crafted precious metal dealer registered and regulated by the Texas Office of Consumer Credit Commissioner (OCCC).

2) Services covered by these Terms

We offer three service types:

  1. AGT In-Person Purchase (Austin only): We schedule an appointment at an AGT location in Austin, Texas, where AGT may purchase eligible items from you.

  2. Partner Location Appointment Booking (Austin only): We schedule an appointment with an independent partner business. In this service, AGT acts as a booking platform only.

  3. Remote Quote + Mail-In: We provide an online estimate and invite you to send items via secure mail using our provided shipping kit. AGT may purchase eligible items after inspection.

Specific terms for each service type appear in Sections 6–8.

 

3) Eligibility and basic rules

By using the Services, you represent that:

  • You are at least 18 years old and legally able to enter into contracts.

  • You will provide accurate, current, and complete information.

  • You own the items you submit or have legal authority to sell them.

  • Items are not stolen, encumbered, or subject to any claim.

We may refuse service, cancel appointments, or decline to make an offer at any time, to the extent permitted by law.

 

4) Identity verification, legal compliance, and records

We may require identity verification, including a government-issued photo ID, and may record certain transaction details as required by applicable law (including local ordinances and law enforcement reporting requirements where applicable).

If you cannot or will not satisfy our verification requirements, we may refuse to complete a transaction.

 

5) Quotes, offers, and how pricing works

Important: Any price, range, or quote you see online or receive by phone/text/email is only an estimate unless we explicitly state it is a binding offer in writing.

Final pricing depends on inspection and verification of:

  • metal type (e.g., gold content/karat), weight, and condition;

  • authenticity and eligibility;

  • market conditions; and

  • legal and compliance requirements.

A purchase occurs only if:

  1. we make you a final offer, and

  2. you accept it, and

  3. we complete verification and payment steps.

 

6) Service 1 — AGT In-Person Purchase (Austin)

If you book an appointment at an AGT location:

6.1 Buyer

AGT is the buyer in the transaction (if a purchase occurs).

6.2 Bring ID

You must bring a valid government-issued photo ID and any other information we request.

6.3 Testing and evaluation

We may weigh and test items using common industry methods (including non-destructive methods). In some cases, additional testing may be required.

6.4 Offers

Any in-person offer may be valid only during your appointment window and may be withdrawn if circumstances change (e.g., verification issues or updated evaluation results).

6.5 Payment timing and method (same day; cash limits)

If you accept our offer and the transaction is approved through our verification and compliance process, payment is triggered immediately at the meeting after we receive the items and complete evaluation/verification, and can be same-day.

We may pay by cash, check, and/or ACH, depending on transaction size, operational constraints, and legal/compliance requirements.
Cash availability: We may not be able to provide cash for large payments. If you request cash, we will confirm availability before completing the transaction.

7) Service 2 — Partner Location Appointment Booking (Austin)

When you book an appointment at a Partner Location:

7.1 AGT is not the buyer

AGT provides a booking platform only and is not the buyer. The partner business is responsible for the purchase transaction, including pricing, testing, payment, compliance, and any required recordkeeping.

7.2 Your transaction is with the partner

If you sell items at a partner location, your sale is a transaction between you and the partner, subject to the partner’s terms, policies, and procedures.

7.3 No pricing guarantee; partners set their own prices

Partners set their own pricing. Any estimate you see on AGT’s Site is not a guarantee of what a partner will offer, and AGT does not control partner offers.

7.4 Data sharing for bookings

To schedule your appointment, we may share your booking information (e.g., name, contact details, appointment time, and general item description) with the partner. See our Privacy Policy: [link].

7.5 Disputes at partner locations

Disputes regarding pricing, inspection, payment, or the purchase itself must be addressed with the partner. AGT may help route communication but is not responsible for the partner’s actions.

8) Service 3 — Remote Quote + Mail-In (available beyond Austin)

This section applies when you request an online estimate and choose mail-in.

8.1 Mail-in kit, shipping label, and packaging

We provide a shipping kit and a prepaid shipping label. You must follow our packing and shipping instructions.

8.2 Shipping insurance

Our shipping/fulfillment partner insures inbound shipments up to $10,000 USD (ten thousand dollars) per package, subject to the carrier/insurer terms, eligibility requirements, proper packaging, and proof requirements.

Important: Coverage may be voided or reduced if shipping instructions are not followed, the package is improperly sealed, prohibited items are included, or required documentation is missing.

8.3 Receipt, inspection, and final offer

After we receive your package, we will inspect and test the items to determine eligibility and make a final offer. We may request additional verification (identity, ownership, or other information) before making or honoring an offer.

We may decline to make an offer if we cannot verify authenticity, eligibility, ownership, or compliance.

8.4 Accepting or rejecting the final offer

If you accept our final offer, we will trigger payment after acceptance and completion of verification.

If you reject our final offer, we will return the items to you.

8.5 Return shipping (no fee)

If you reject our final offer (or if we decline to make an offer), we will return your items at no fee to you, using a shipping method we determine is reasonable.

You are responsible for providing an accurate return address. We are not responsible for delays or failures caused by incorrect address information.

8.6 Timing and payment method

Payment is triggered after evaluation and completion of verification and can be same-day depending on timing and operational constraints.

We may pay by cash, check, and/or ACH, depending on transaction size, operational constraints, and legal/compliance requirements. Cash may not be available for large payments.

8.7 Out-of-area sellers and legal limitations

You acknowledge that laws may vary by jurisdiction. We may limit or decline remote transactions in certain areas to comply with legal requirements.

9) Prohibited or refused items

We may refuse to evaluate or purchase:

  • items we reasonably suspect are stolen or unlawfully obtained;

  • counterfeit items or items whose authenticity cannot be confirmed;

  • items that create safety, legal, or compliance concerns; or

  • items we are not equipped to process.

 

10) Appointments: cancellations, no-shows, and rescheduling

You may cancel or reschedule using the instructions in your confirmation message. Repeated no-shows or cancellations may result in restricted booking access.

We may cancel or reschedule appointments for operational, safety, or compliance reasons.

11) Communications and consent

By providing your phone number or email, you consent to receive communications about your appointment, quote, transaction status, and customer support. Standard message/data rates may apply. You may opt out of marketing messages at any time.

12) Privacy

Your use of the Services is subject to our Privacy Policy: [link to Privacy Policy].

13) Disclaimers

THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Site will be uninterrupted or error-free.

14) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • AGT WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES; AND

  • AGT’S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE OR SERVICES WILL NOT EXCEED $100 OR THE AMOUNT YOU PAID AGT (IF ANY) IN THE SIX (6) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER.

Some jurisdictions do not allow certain limitations; in that case, limits apply to the extent permitted by law.

15) Indemnification

You agree to indemnify and hold AGT harmless from claims arising out of (a) your breach of these Terms, (b) your violation of law, or (c) your sale or attempted sale of items you do not legally own or have authority to sell.

16) Governing law and venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules.

Unless prohibited by law, any dispute must be brought in state or federal courts located in Travis County, Texas, and you consent to that jurisdiction and venue.

17) Changes to these Terms

We may update these Terms from time to time. The “Effective date” will show the latest version. Your continued use of the Services after changes means you accept the updated Terms.
